Bipartisan legislation sponsored by Senator Vince Polistina has been signed into law, allowing restaurants and certain alcoholic beverage retailers in New Jersey to permanently utilize adjacent outdoor spaces and public sidewalks. This development follows the temporary provisions introduced during the COVID-19 pandemic.
Senator Polistina expressed that these measures were beneficial for New Jersey businesses during the pandemic. "New Jersey businesses benefited immensely from the innovative measures we adopted during COVID to enable the use of outdoor spaces," said Sen. Polistina. He further stated that making these laws permanent would provide local businesses with the flexibility needed to thrive. "This is a big win for business, residents, and local economies."
The previous law permitting such operations was set to expire on November 30, 2024. With Senator Polistina’s bill, S-3608, restaurant and bar owners can continue using outdoor areas they own or lease near their establishments for selling food and beverages. Businesses wishing to use these spaces must apply through their municipal zoning officer.
