The New Jersey Senate has approved a bipartisan bill, sponsored by Senator Vince Polistina, which aims to make permanent the temporary COVID-era regulations allowing restaurants and certain alcoholic beverage retailers to use adjacent outdoor spaces or public sidewalks. This legislation seeks to extend the current law set to expire on November 30, 2024.
Senator Polistina expressed support for the initiative, stating: “Businesses and consumers have not only accepted these outdoor restaurant spaces but have grown to love the expanded options they provide.” He emphasized that this move signals that "New Jersey is open for business," fostering an environment where communities can thrive.
The proposed bill, S-3608, permits owners and operators of dining establishments and beverage retailers such as bars, distilleries, or breweries to utilize outdoor areas they own or lease near their businesses for serving food and drinks. To do so legally, proprietors must submit applications with their local municipal zoning officer.
