Senator Vince Polistina's bipartisan bill, which aims to make permanent the temporary COVID-era laws allowing restaurants and certain alcoholic beverage retailers to utilize adjacent outdoor spaces or public sidewalks, has passed the Senate Budget and Appropriations Committee.
"In the years since COVID, businesses have benefitted immensely from the use of outdoor spaces and the public has come to appreciate those expanded options," said Sen. Polistina. "By making sure the temporary law becomes permanent, we can ensure that businesses continue to flourish."
The proposed legislation, known as S-3608, would permit owners and operators of restaurants, bars, distilleries, or breweries to use outdoor spaces they own or lease that are adjacent to their business for selling food and beverages. To use these outdoor areas or public sidewalks, owners must file applications with the municipal zoning officer in accordance with procedures established by the temporary laws.
The current temporary law permitting businesses to operate in these spaces is set to expire on November 30, 2024.
