Senator Carmen Amato, Jr., Assemblyman Brian Rumpf, and Assemblyman Greg Myhre from New Jersey’s 9th Legislative District have raised concerns about a proposed rule from the Department of Labor that could alter how independent contractors are classified in the state.
In a letter sent to Department of Labor Commissioner Robert Asaro-Angelo, the lawmakers highlighted feedback they received from their constituents regarding the proposed changes. According to the letter:
“As of this writing, our district office has received more than 50 letters from constituents who are deeply concerned about a proposed rule from the New Jersey Department of Labor and Workforce Development that would drastically change how the state classifies independent contractors.
These constituents strongly believe that proposed new rules (N.J.A.C. 12:11) stand to threaten the livelihoods of hundreds of thousands of people across the state by implementing an “ABC” test for independent workers, freelancers, and contractors.”
The lawmakers urged the Department of Labor to reconsider moving forward with these regulations. The “ABC” test referenced in their letter is a method used in some states to determine whether workers should be classified as employees or independent contractors.
