Bill aims to protect New Jersey farmers from nuisance lawsuits

The Senate Economic Growth Committee has passed a bill introduced by Senator Parker Space aimed at enhancing the legal protections for commercial farmers under the Right to Farm Act. The legislation seeks to address the challenges faced by farmers due to nuisance complaints.

Senator Space expressed concerns about the financial burden such complaints place on farmers, stating, “It’s hard enough to make a living farming the land so it’s especially costly for farmers to have to deal with nuisance complaints.” He emphasized that preserving the way of life for farmers is crucial in maintaining New Jersey’s agricultural heritage.

The proposed bill outlines a process whereby a farmer can apply to either the county agriculture development board or the State Agriculture Development Committee (SADC) if they believe a complaint was made in bad faith. Should evidence support this claim, an order would be issued requiring the complainant to cover reasonable costs and fees incurred by the farmer.
